Marriage Rights And A New Madame Justice

It's late, and school is yet to wrap up, so I am dead-dog tired. But I had to comment on how disappointed I was by the confused decision here in California regarding equal marriage rights for all. On one hand, the California Court decided that Prop. 8 would stand. Ridiculous. But to add insult to injury, the marriages of those who acted during the small window of eligibility could remain legally married. Huh??? That makes no sense. "Okay, no more gay marriages, but you guys over there, the ones who acted before the boom fell? You can stay married, I guess..." I think this was a bone being thrown by the courts to the gay and lesbian community. The decision not to repeal Prop. 8 was surely based on the fact that, unlike the Supreme Court, the members of our high court are elected to office. There had been very vocal threats by the Christian Right of recall elections for those who voted to repeal. A true politicizing of a court decision. I am dismayed by the actions of our State's highest court today.

As for the nomnation today, many of us were right that President Obama would choose a woman and an Hispanic woman at that! (Way to go, Politicos! You know who you are...) Interesting choice: the left ain't happy and the right ain't either...I read up on a few of the more controversial cases (New Haven? firefighters and Gant case), and it seems Sotomayor may not have found her voice yet as a judge. My hope is that she can stand up to Scalia. I hope that her stand on choice will be made more apparent in the days to come. And I hope she does lean as liberal as Sen. Boxer stated tonight on Rachel's show. Time will tell, and in the meantime, I'm getting some shuteye - 17 more school days until summer vacation, Kids!

I don't think anyone understands the Prop 8 ruling... I do believe it will go to the US Supreme Court and it may be one of the first major cases Sonya Sotomayor gets to hear...wouldn't that be wonderful. I think she is a center leftie.. not a flaming leftie, but a center left. The ruling she made was on the Mexico City law.. which is a world wide law and I think that is why she ruled in the way she did.. because it was not just for this country. I could be wrong..but that is my opinion, from what I have read of her. If that is the case then I can understand. We, as a country, really have no right to inflict our views on the entire world. That was one of the things we hated about the Bush Mis-Administration.
If that is the only thing the left can find against her, and if the right is yelling as much as they are.. she must be great.

I think we'll see this go further, too, Annette. The language of the proposition is couched nearly identitically to the anti-mixed marriage laws of the south. There is a definitive "separate but not equal" going on...
I think you're right about the right - no pun intended. ANything that has them ehis stirred up has to be a good thing! ;) I just wish I knew more about Sotomayor's views on choice, privacy rights and all my other "liberal leaning" views. Confirmation hearings should be interesting. We'll see some real sexism and racism on display from the GOP, and I don't think there will be much done to disguise it - classic GOP "divide and conquer," fear-mongering strategies. Hang on to your hat, Girl, it could get interesting! Thanks for stopping by and putting in your two cents! You always make me think - a very good thing!

You crossed me up, MP. Posting on Tuesday...what's with that? :) I am with Rachel though, when does the left get their Scalia? Ever? The right is in the minority, but we cater to them on everything. How about, "suck it, conservatives?" Let's give them a SC nominee that REALLY scares the crap out of them next time.

I am feeling the same way re: where's our Scalia? Great phrase! Start making bumper stickers! I am frustrated as of late that we have had all this political capital, but am wondering how log he'll have it if the Prez doesn't start spending it. We need a true liberal on the court. The Rachel drink analogy works. There's been debate from some of my fave bloggers about the wheels of Washington grinding slowly. And I get that, but I am still impatient for true change to occur.
